New Downtown CB Vacation Rental Licensing Rules
I recently had the opportunity to get the update directly from Eric Treadwell who oversees the new downtown CB Vacation Rental licensing rules. Effective January 1, 2023 New Downtown CB Vacation Rental Licensing Rules go into effect. The moratorium that has been in place for over a year to obtain a business license for Short-Term Rental (STR) of your home in downtown Crested Butte has been lifted.
Highlights – New Downtown CB Vacation Rental Licensing Rules
Here are the highlights of the new downtown Crested Butte vacation rental licensing rules – there are two types of licenses: “Primary” and “Unlimited” vacation rental licenses.
Primary License
- Local who lives in home or long-term rents home for a minimum of six months per year.
- Cannot rent for more than 90 total nights per year.
- No cap on the number of Primary Licenses issued.
- Permitted in all zones.
- $250 license fee.
Unlimited License
- Second homeowner who does not live or long-term rent home for a minimum of six months per year.
- Unlimited rental nights per year.
- Use it or lose it – Required to rent their property for a minimum of 30 nights per year (or subject to lose their license).
- Maximum of 198 Unlimited licenses issued.
- Permitted in zones: R1, R1A, R1C, R1D, R1E, R2, R2C, R3C, B3, B4.
- $800 license fee.

Additional Downtown CB Vacation License Details
- All existing license holders will be “grandfathered-in”.
- Renewals and applications ONLY accepted from October 1 – October 31 for the next calendar year.
- Licenses are non-transferable – when a home is sold, the new owner has to apply for new license – wait until October application timeframe.
- There can be no more than two “unlimited” vacation licenses on any town block face.
- There are ten qualifying zoned districts where STRs are permitted (see map).
- A local contact person must be listed on the license to be able to respond to complaints.
- No licenses will be issued on homes that have a deed restriction (ie: affordable housing, mixed use zoning…etc.).
- One license per person.
- Application and inspection required for all licenses – includes providing minimum amount of parking.
- Must collect applicable sales tax of 7.5% and vacation rental excise tax.
Of Interest:
Per Colorado law you can LONG-TERM rent your property for 30 days or more – and there is no license required.
